Jail Not Sanitary

When entering the jail you have to shower and wash your hair and then get sprayed down with bug preventative before entering into population.

Tell me how then, could there be cases of head lice? This is something that shouldn’t be on existence as they are “supposed” to prevent that type of thing from happening. So what is wrong the whole setup? Why do they allow such a thing to occur and the most important question of all, why do they not treat it once it occurs but tell the affected inmates that they will bring them some medicine yet it turns out to be a “preventative” treatment which is NOT designed to correct the issue just prevent it from happening which obviously doesn’t work either or it would not have come about.

I know this is not vacation nor a 5 star hotel but there are certain fundamentals and basic criteria they are supposed to adhere to as there are the basic rights of inmates for for the simple fact they are human beings and this is way outside those boundaries that have been established by our leaders in the government as well as just plain out the right way to treat people.

I would like to ask that people share this information with all that you know and maybe someone will see this post and get this place up to par on how they handle a situation like this.

Probation

Probation or Magistrate?

These days it seems our probation office or Magistrate is a bit overloaded. I guess you could say this because so many are slipping through the cracks as far as awareness goes. Inmates in the local jail are being overlooked because the probation office isn't aware they are at the jail. There seems to be a communication breakdown somewhere and it's becoming increasinly worse. The most recent that I've heard of a female being incarcerated for 28 days and they didn't even know she was there. Luckily, she had someone helping her on the outside to get them moving on her case. It's a shame because not everyone has this option. Not all inmates have people on the outside to keep things going for them. Once incarcerated they are simply either forgotten or their people don't have any idea who to contact in regard to their particular situation. Most are being incarcerated because of bond conditions which are ridiculous and unconstitutional as it violates our rights to be treated as innocent until proven guilty. This method is guilty until proven innocent and on top of that any money, time or behavior invested or otherwise is NOT credited toward any future conviction and there may just be a good enough attorney out there to prove your innocence. This is an unfair stipulation put into place to overload our Justice system and make more money for our government. Everyone on bond conditions must pay for their own drug tests no matter how many times per week and some are even being visited by DRC members before they are even taken to arraignment to get them enrolled. I say to our local governemnt stop and think about what our forefathers set in place and what they went through to get it that way and stick to the plan these are the major rules you know? That's like taking the Ten commandments and putting your own spin on it for the changing times. It's neither moral or fair nor ours to change. There are those out there that are actually innocent no matter what your thoughts.

There are the conditions of bond release typical of our justice system like don't get into anymore trouble while we are allowing you to go free for the moment and things like that. That is par for the course and completely understandable. These are not in violation of any rights as they stand and are common. What is not right in my opinion, is the fact that when you are released in this present time, you must visit our local probation office to be monitored at least once a week, some even twice. Drug tests are being implemented even for misdemeanor charges and the defendant is having to pay for them. You haven't been found guilty of anything yet and you are already paying the price as if you had. None of the time or effort spent being credited towards any adjudication if you happen to be found guilty or plea bargain. So my opinion is that this is yet another way to generate more revenue for our dear county's whatever they want it for without regard to any financial burden on the defendant, possible trouble for time out of work to do so. I have found no legal code governing bond conditions in a detailed sense so there's nothing really to reference to fight it but on the surface it just seems like another way to charge and get more money from those who offend the laws put in place. I agree with the conditions set forth for stalking and battery charges but others are just ridiculous and as long as they are non-violent offenses why bombard the probation office with all these people in there unnecessarily? Makes no sense. Either way, it is what it is and it's just another reason to keep this site going because our legal system these days is all messed up and they don't follow the rules set forth in the U.S. Constitution, The Bill Of Rights or anything else our forefathers set forth in hopes of creating a free America. Law works for Whom?

The law is really a pain in the ass when you dive a little deeper into it.  It’s something that tries to be all to all people which nothing can be.  So you have your primary laws and those can be argued and followed but they are at the discretion of a judge.  Then there’s several other laws like Civil Law, Case Law, Common Law and oh my gosh the list goes on and on.  It all boils down to this….no matter which law you are researching or referencing or inquiring about, it doesn’t really make a difference it will be what the judge wants it to be.  No jury will help because once they hear certain charges, you are automatically guilty.  No matter the circumstance no matter the procedures that were followed or not followed.  So truthfully the law helps none for the layman out there who may have just been in the “wrong place at the wrong time” and is only getting worse everyday.  It’s all about the money.  Instead of it costing the courts and the jails, etc.  they are making money hand over fist and some are even abusing their authorites.

I mean how can you have a judge that judges drug cases be sent to a rehab facility for abusing drugs then allow that judge to return to the bench?  That my dear is a conflict of interest.  I guarantee you that 99.99% at least of the drug cases that are heard in this county are somehow paying for the crime and it’s possible that some of them are not.They were just in the wrong place at the wrong time.  Most couldn’t afford an attorney so they had to be represented by an attorney that really is overloaded for one, doesn’t want to piss the judge off by telling the courts what a bunch of incomplete, no procedure following, half wit investigators they have on the case to start with and defend their clients innocence.

Also, the magistrate judge that issues these warrants for search and seizure has never refused to sign any warrant brought before him.  Now that is being judgemental huh?  I would also be willing to bet you that a good bit of those shouldn’t bave even been issued.  That they didn’t even make  sense to approve.  Just bring it in and get it signed no problem.

That sums up some of my opinion on some of our valiant legal system.  Tune in for more later as I continue to let you know how I feel about those that govern our great town and society as a whole.

Harassment?

Doing their job or just plain harassment?

The case of a young man on a drive to our little town to visit family is a quite puzzling one.  From what I was told (and of course the 2 sides to every story apply) this young man was traveling south on 411 from Tennessee when he met a silver Dodge Charger or similar vehicle.  He glances at the driver as he passes and the net thing you know the car is behind him with unmarked car lights flashing.  This means they were no on top like a patrol car.  He pulls over and asks the gentleman that approached his car what the problem was, why did he pull him over.  The response was I'll figure that out in a  minute hold on while this gentleman carried on a phone conversation.  Tune in for the rest of the story......later.......

Solution or Institution?

Why does the system stay so busy?  I'll tell you one reason why, it's because the system is designed to have you fail.  There are so many programs in place, the courts are overloaded and they continue to keep those that enter hanging on the line.  Why can't they come up with a solution instead of an institution?  Why don't they look at alternatives to prison or jail?  They don't reform,  they recycle and re-program to become institutionalized that's what they do.

Most that are in the system are not the molesters, murderers and thieves of the violent type but drug charges.  Most are not violent in nature either.  Most are users and not getting the drugs to minors or the like but just average users.  I'm not a drug user myself but it seems as if they want to damage themselves then let them do it.   Unless they become a nuisance and start thieving to feed it or hurting others then let them go.

Gilmer County Jail

Our Local Jail

So our jail is not so prestigious and is not a gated community of any sort.  The place places you on a diet as they restrict food resources, they serve bologna sandwiches once a day either for lunch or supper, the days alternate.  Their inmates  with medical conditions may as well forget it because I have a diabetic friend was not allowed his daily required doses of insulin as "they" those with no medical degree didn't see the need for more than 2 doses a day.

Communication with the outside world is minimal due to the phones being turned off most of the day with the excuse that court is in session and their are other inmates in transit even though court isn't held daily and most in the women's dorm that couldn't bond out due to whatever reason rarely took the trip to court.  You have no privacy to shower or use the toilet and there are men mostly working in  the  tower that overlooks all and can see all.  It's loud and obnoxious and you don't get much sleep at night.

They do however hold AA meetings once a week and have the church volunteers come by.  As far as any rehabilitation going on there is none either in our county jails or in state prisons.  All these places do is generate funds for either our government or the private owners.  They only institutionalize those that spend time there and it carries over when they are released making it tougher on them to be successful when released.

Our Local Legal System

Our legal system has been corrupted.  Our forefathers are rolling over in their graves with what has become our legal system that governs our present society.  They produced the Constitution and the Bill of Rights for the right reasons and our modern day government has bent, sretched and poked it so far out of shape that nobody can even begin to interpret or use any of them as a guide.  Many judges see things in different ways and that is good to a point but for the most part, they decipher it based on a blanket assumption which most times is guilty.  

So I say to our legal system.  Sometimes people have been done wrong by your esteemed crews that are in place to protect and serve.  Sometimes these people in power are corrupt, don't do things as they should and all for who knows what.  Maybe it's to make a name for themselves or maybe just to continue being a bully like they have always been, who knows?  Nonetheless, they are wrong sometimes.  Maybe if you considered that more often your courts wouldn't be so overwhelmed.

Bond Conditions For Everybody? No Matter What the Charge?

Innocent until proven guilty?  It hasn’t been for quite some time but now it’s obvious.  It’s guilty until proven innocent.  It seems our esteemed county is forcing bond conditions no matter what charge a defendant has.  Seems a little extreme to me that the taxpayers should have to foot the bill to start monitoring a defendant that may or may not even go to court for 2 years.  Either way, it is what it is and there’s nothing we can do about it except each individual can file for a modification of the said conditions.  It’s just one more thing our justice system can add that keeps us wondering.  At some point there has to be a fine line between harassment and justifiable but that’s for another post.
